Interactive forms of training are very diverse and are widely used in the educational process of the Academy. When studying the discipline “Application of the norms of civil procedural legislation” among interactive forms of training, a special place is occupied by the business game “Court proceedings”.
The main goal of such a lesson is to gain practical experience in considering and resolving civil cases in the court of first instance, as well as to understand the essence and social significance of the future profession, to show a constant interest in it.
Thus, on October 2 of this year, a court hearing was held in the form of a business game on the discipline “Application of the norms of civil procedural legislation”.
Master’s students of groups 24-1 қ and 24-2 қ played the role of judges and persons participating in the case.
Each group, in the order of claim proceedings, prepared for different civil cases and in court proceedings in accordance with the norms of the Civil Procedure Code of the Republic of Kazakhstan, performed procedural actions in the following sequence:
• opening of the court session and announcement of the case to be considered, as well as the use of audio and video recording of the court session; • checking the attendance of the participants in the process;
• removing witnesses from the courtroom;
• announcing the composition of the court and explaining the right of challenge;
• explaining to the persons participating in the case their procedural rights and obligations;
• allowing the court to submit motions of the persons participating in the case;
• explaining to the specialist his rights and obligations;
• beginning the consideration of the case on the merits;
• hearing the explanations of the persons participating in the case and establishing the procedure for examining the evidence;
• warning the witness about liability for refusing to testify and for knowingly giving false testimony;
• interrogating the witness;
• examining written, physical and electronic evidence;
• hearing the consultations (explanations) of the specialist;
• completing the consideration of the case on the merits;
• holding judicial debate and responses;
• hearing the prosecutor’s opinion;
• the court retired to issue a judicial act;
• after the court’s decision was made and signed, the judge announced the decision, explained the legal grounds and consequences of its adoption, the procedure and time limits for appealing the decision;
• the court declared the court session closed.
After the court session, the actions of the master’s students who participated in the business game were assessed by the teacher E.O. Egemberdiev, the advantages and disadvantages were voiced. Everything was discussed openly and comprehensively, since this was an educational process.
