On December 17, 2024 a petition to abolish the private bailiffs in Kazakhstan has been published on epetition.kz.
The coordinator of research and international projects of the Academy of Justice, Master of Law, PhD student, Nurtan Azamat Yerlanuly, after conducting a legal analysis of this issue, comes to the conclusion that the problem lies not in the Institute of private bailiffs itself, but in the mechanism of implementation of legal norms and the reluctance of debtors to take responsibility, and therefore liquidation of this institute is unacceptable. According to Nurtan Azamat, instead of drastic measures related to the elimination of private bailiffs (that is for Kazakhstan, in comparison with the experience of advanced countries, will be regarded as a step backward), mechanisms should be developed to further improvement of the procedure of private execution in order to restore the subjective rights of individuals.
