Can Movable Property Be Recovered Through a Notarial Executive Inscription, or Is This Another “Gap” in Our Legislation?

An article by Gulshat Omirserikovna Takisheva, Acting Senior Research Fellow at the Academy of Justice under the High Judicial Council of the Republic of Kazakhstan, titled “Can Movable Property Be Recovered Through a Notarial Executive Inscription, or Is This Another ‘Gap’ in Our Legislation?” was published in the scientific and legal journal “Bulletin of the Institute of Legislation and Legal Information of the Republic of Kazakhstan.”

The article explores the issue of practical implementation of Article 92-1 of the Law of the Republic of Kazakhstan “On Notaries,” which provides for the possibility of recovering movable property through a notarial executive inscription. Although this provision has been in force since 2016, notarial practice demonstrates an almost complete absence of its application in practice.

The author analyzes the causes of this situation, pointing to the evident gaps in the current legislation and the lack of a clearly regulated procedure necessary for the enforcement of claims involving movable property.
