An article authored by Maygul Nestayevna Abilova, Director of the Center for Academic Programs and Projects of the Academy of Justice under the High Judicial Council of the Republic of Kazakhstan, and Azamat Yerlanuly Nurtan, Senior Research Fellow of the Academy, was published in the scientific journal «Bulletin of the Law Enforcement Academy» (Issue No. 3 (37), 2025).
The article examines the challenges associated with the implementation of conciliation procedures in the civil law sphere. The authors’ choice of topic stems from the insufficient regulation of conciliation procedures and existing gaps and inconsistencies in the legislation of the Republic of Kazakhstan, which have led to an unclear understanding of the mechanisms for their practical application.
The authors conclude that incomplete and inconsistent legislative regulation of conciliation procedures contributes to their improper use and fosters a distorted public perception of these mechanisms, often associated with a lack of trust in their effectiveness.
